If the deceased had properly arranged his or her affairs during their lifetime and executed a valid Will, the estate administration process is generally more straightforward. The Executor(s) appointed under the Will will ensure that the estate is distributed to the named Beneficiaries in accordance with the deceased’s wishes.

However, where there is no Will, or where the Will is invalid or defective, the process becomes more complex. In such circumstances, an application must be made for a Letter of Administration in order to administer and distribute the deceased’s estate.

When is a Letter of Administration (LA) required?

There are several situations in which a Letter of Administration may be required, the main circumstances being as follows:
·     The deceased did not leave a Will.
·     The Will has been declared invalid, for example where it fails to comply with legal formalities such as the absence of two witnesses’ signatures.
·     No Executor has been appointed under the Will, and therefore no party is legally empowered to administer the estate.
·     The appointed Executor(s) are unable or unwilling to act, for example due to death, mental incapacity, or other circumstances rendering them unsuitable to discharge the role.


Do I need a lawyer to apply for a Letter of Administration?

Although the law does not strictly require the application for a Letter of Administration to be made through a lawyer, self-application carries significant legal risks. As with all Wills and Probate-related procedures, this is a complex legal process in which even a minor error may result in the application being rejected. Such errors may cause substantial delays, during which the estate may remain unadministered and effectively frozen.
