GEORGE TOWN (June 4): Penang Development Corporation (PDC) and Aspen (Group) Holdings Ltd have officially closed all matters related to the Batu Kawan Industrial Park 2 (BKIP2) request for proposal (RFP) exercise, bringing an end to a dispute that had attracted public attention in recent months.
In a joint statement, both parties confirmed that all outstanding issues arising from the BKIP2 RFP process were resolved following a meeting between them. They also agreed that no further public statements would be made on the matter.
PDC, as the authority responsible for evaluating the proposals, reiterated that it had exercised its full discretion and prerogative in assessing submissions under the RFP process. Aspen acknowledged and respected PDC’s role and authority in determining the outcome and confirmed that it would not challenge the decision.
Both parties noted that previous public statements made during the dispute were issued in good faith and reflected their respective understanding of the proposal and evaluation process at the time.
The discussions also addressed issues relating to bridge construction and Aspen’s request for a first right of refusal over approximately 580 acres of adjacent PDC-owned land. Following direct discussions, both parties agreed to consider these matters resolved and closed.
The resolution highlights the importance of clear governance and decision-making authority in large-scale land and industrial development projects. PDC successfully reaffirmed its role as the sole evaluator of the BKIP2 tender process, while Aspen chose to accept the outcome rather than pursue further challenges.
The settlement also removes uncertainty surrounding BKIP2, allowing both parties to move forward and focus on future development opportunities. For investors, the closure of the dispute reduces potential legal and reputational risks associated with the project and signals a willingness from both sides to resolve disagreements through direct engagement rather than prolonged public disputes.
